Terms of service

1. About these terms

These terms are an agreement between you and Avenue.io Inc. (“Avenue.io”, “we”, “us”), a company based in Alberta, Canada. They apply to our website at avenue.io and to our products: Alberta.io, Attractionator, YourCadets, GeoJSON.cloud and AeroVenture, including their websites, web applications, mobile apps and games (together, the “Services”).

By using the Services you agree to these terms. If you use them on behalf of an organization, such as a cadet group or an attraction, you confirm that you are allowed to accept these terms for it. Some Services have additional terms, such as a pricing page, a separate agreement or an order form. Those additional terms form part of this agreement and apply if they conflict with these terms.

Our privacy policy explains how we handle personal information.

2. Accounts

  • You must give accurate information when you create an account and keep it up to date.
  • You are responsible for keeping your password safe and for what happens under your account.
  • You must be old enough to agree to these terms where you live, and at least 13 years old.
  • Tell us right away at hello@avenue.io if you think your account has been misused.

3. Plans, payments and cancellation

  • Some Services are free and some are paid. Prices, what each plan includes, and any free trial are shown on that product's pricing page or in your order.
  • Subscriptions renew automatically at the end of each billing period, monthly or yearly, until you cancel. We charge the payment method on file through our payment processor, Stripe.
  • You can cancel at any time from your account settings or by contacting us. Cancellation takes effect at the end of the current billing period, and you keep access until then.
  • If a free trial ends and you have not cancelled or added a payment method, the paid features stop until you choose a plan.
  • Unless the law requires otherwise or we agree in writing, payments are not refundable, including for partial billing periods.
  • We may change prices. We will tell you at least 30 days before a change affects your subscription, and you can cancel before it takes effect.
  • Prices do not include taxes unless stated, and you are responsible for applicable taxes.

4. Apps and games from app stores

If you get one of our apps or games from the Apple App Store, Google Play or Steam, the store's own terms also apply, and purchases, refunds and billing through that store are handled under the store's rules.

For apps downloaded from the Apple App Store, you and we also agree that:

  • these terms are between you and Avenue.io, not Apple, and Avenue.io, not Apple, is responsible for the app and its content;
  • Apple has no obligation to provide maintenance or support for the app. If the app fails to meet any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the extent the law allows, Apple has no other warranty obligation;
  • Avenue.io, not Apple, is responsible for addressing any claims about the app, including product liability, legal or regulatory compliance, consumer protection, and claims that the app infringes someone's intellectual property;
  • you confirm you are not located in a country, and are not a person, subject to Canadian or US sanctions; and
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

5. Your content

You keep ownership of the content you add to the Services, such as text, images, files, events and maps. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, display and transmit that content only as needed to run, secure and improve the Services for you, and to show it to the people you choose to share it with. This licence ends when you delete the content or your account, except for copies in backups for a limited time and content others have already shared.

You are responsible for your content and confirm that you have the rights and any consents needed to use it, including permission from people who appear in photos or listings you publish.

6. Acceptable use

When using the Services, you must not:

  • break the law or infringe anyone else's rights, including privacy and intellectual property rights;
  • post content that is hateful, harassing, threatening, sexually explicit, or that exploits or endangers minors;
  • impersonate someone, or mislead people about who you are or who you represent;
  • send spam or unsolicited messages through the Services;
  • try to access accounts or data that are not yours, probe or break our security, or interfere with the Services working for others;
  • scrape, copy or resell the Services, or reverse engineer them, except where the law allows despite this term; or
  • use the Services to build a competing product.

We may remove content or suspend accounts that break these rules.

7. Our intellectual property

The Services, including their software, design, artwork, characters, text and trademarks, belong to Avenue.io or our licensors. We give you a personal, limited, non-exclusive, non-transferable licence to use the Services under these terms. For AeroVenture and our other apps, that licence lets you install and play or use them on devices you own or control. All other rights are reserved.

If you send us feedback or ideas, we may use them without any obligation to you.

8. Information and third-party services

Some Services show information from other sources, such as news, weather, wildfire, energy and map data on Alberta.io. We work to keep it accurate and current, but we cannot guarantee it. Do not rely on it for emergencies or safety decisions: follow official sources and authorities.

The Services may link to or work with services run by others, such as Google, Apple or Steam. Those services are governed by their own terms, and we are not responsible for them.

9. Changes and availability

We are always improving the Services and may add, change or remove features. We aim to keep the Services available but do not promise they will always be uninterrupted or error-free. If we discontinue a paid Service, we will give you reasonable notice and a pro-rated refund of any prepaid fees for the unused period.

10. Ending your use

You can stop using the Services and delete your account at any time. We may suspend or end your access if you break these terms, if your use creates a risk or legal exposure for us or others, or if your account is unpaid. Where reasonable, we will tell you first and give you a chance to export your content. Sections that by their nature should continue, such as ownership, disclaimers and limits of liability, continue after your use ends.

11. Disclaimers

To the extent the law allows, the Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Some places do not allow these exclusions, so they may not all apply to you.

12. Limitation of liability

To the extent the law allows, Avenue.io will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or 100 Canadian dollars. Nothing in these terms limits liability that cannot be limited by law.

13. Indemnity

If you use the Services for an organization or business, you agree to cover Avenue.io's reasonable losses and costs, including legal fees, arising from third-party claims about your content or your breach of these terms.

14. Governing law

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. You and we agree to the courts of Alberta for any dispute, unless the consumer protection laws where you live give you the right to bring a claim in your local courts.

15. Changes to these terms

We may update these terms. We will post the new version here with a new date and, for significant changes, tell you by email or in the Services at least 30 days before they take effect. If you keep using the Services after that, the new terms apply. If you do not agree, you can stop using the Services and cancel any subscription.
